SC Lifts election code, Says Welfare Programmes To Continue
Here is a sweet and sour like judgment given by the supreme court in respect of local body elections in Andhrapradesh. The supreme court has stated the election commission has every right and fully empowered whether to conduct the elections or not. But the Court also said that it was required for EC to consult the State Government before taking the decision of postponement of elections. The court said that code of conduct can be rolled back and continue the implement the welfare schemes in Andhrapradesh. On Wednesday the Supreme Court heard the petition AP Pradesh government challenging the ECs order postponing elections local bodies for six weeks.
Chief Secretary Nilam Sawhney earlier wrote to the State Election Commissioner N Ramesh Kumar requesting that the order postponing the polls be revoked and conduct the elections as per the schedule announced earlier. The Dharmasanam comprising of Chief Justice SA Bobde, Justice BR Gawai, Justice Suryakanth has delivered the judgment and said that the EC can impose code of conduct just four weeks before the commencement of elections.
